What Is Colorado Regulation 28?
Regulation 28 (5 CCR 1001-32), established under HB 21-1286 and refined by HB 25-1269, is Colorado's mandatory building performance standard. It requires commercial, multifamily, and public buildings at or above 50,000 square feet to measure, report, and reduce their energy use and greenhouse gas emissions each year.
The program is administered by the Colorado Department of Public Health and Environment (CDPHE) through the Air Quality Control Commission, with support from the Colorado Energy Office (CEO). It's commonly referred to as the Building Performance Colorado (BPC) program.
Colorado's stated targets: a 7% collective GHG reduction by 2026 and a 20% reduction by 2030, measured against 2021 baseline emissions from covered buildings.

Four Ways to Comply -- We Help You Pick the Right One
Regulation 28 gives building owners flexibility. The right pathway depends on your building's current energy profile, its use type, and how much investment you're willing to make upfront. Our auditors model all four before recommending one.
Prescribed EUI Target
Your building must reach a specific Energy Use Intensity (kBtu/sq ft/year) set by CDPHE based on your building's primary use type.
Site EUI Reduction
Reduce your site EUI by 13% by Dec 2026 and 29% by Dec 2030, compared to your 2021 benchmarked baseline.
GHG Intensity Target
Hit a specific greenhouse gas intensity level (metric tons CO2e per sq ft) based on your building type as set by the AQCC.
GHG Emissions Reduction
Reduce total GHG emissions by 13% by 2026 and 29% by 2030 vs. your 2021 baseline -- regardless of EUI.
From Audit to Compliance in Four Steps
We keep it straightforward. No unnecessary back-and-forth, no consultancy bloat. You get a compliant building and documentation to prove it.
Building Intake and Benchmarking Review
We collect your ENERGY STAR Portfolio Manager data, utility bills (2021-present), and your current benchmarking submissions to CDPHE. If you haven't started benchmarking, we help you set that up first.
On-Site Energy Assessment
Our ASHRAE-qualified auditors conduct a thorough physical inspection of your building's mechanical systems, envelope, lighting, and controls. We document energy-consuming systems as required under ASHRAE Standard 211.
Pathway Analysis and Audit Report
We model your building against all four Regulation 28 compliance pathways and identify the most practical route based on current performance, planned upgrades, and budget. You receive a full audit report including a list of Energy Conservation Measures (ECMs).
Compliance Documentation
We prepare all documentation required for CDPHE reporting, including your selected compliance pathway declaration and supporting audit data. You submit to the state -- or we walk you through the submission.
