Starting in 2026, the annual benchmarking report is due November 1 each year. Buildings must submit energy use data through ENERGY STAR Portfolio Manager or an equivalent tool approved by CDPHE.
Does Regulation 28 apply to all Colorado buildings?
No. Regulation 28 applies specifically to commercial, multifamily residential, and public buildings at or above 50,000 square feet. Buildings below that threshold are not currently covered by the mandate.
What is the Colorado Energy Office's role in Regulation 28?
The Colorado Energy Office (CEO) provides technical assistance, compliance resources, and coordinates with building owners and utility partners. Actual enforcement authority sits with the CDPHE Air Quality Control Commission.
